Terms of service
These terms are an agreement between [Company name] Ltd ("we", "us") and the academy, school or teacher that signs up to use Fatiyyah Academy ("you", the "academy"). People the academy invites, such as teachers, students and parents, use Fatiyyah Academy under the academy's account and must follow the acceptable use rules below.
1. The service
Fatiyyah Academy is an online classroom for teaching the Quran and Islamic studies: a shared mushaf with marking and drawing, live audio and video, scheduling, progress records, homework, hifz plans, optional lesson recording, and web, Android and iOS apps. [In this version it is a web app, which can be installed on a phone or computer, for daily hifz lessons, recitations recorded at home or in class and marked by the teacher on the mushaf, check-ins, progress records and daily reports for parents. Live lessons are not used, so there is no live audio or video, shared drawing or lesson recording; scheduling and homework apply only if the academy turns them on, and both are off by default; and there are no Android or iOS apps.] We may improve and change the service over time. We will not remove a core feature you rely on without telling you at least 30 days before.
2. Accounts
- The person who creates the academy confirms they have authority to accept these terms for it.
- Academy administrators manage who joins, their roles and their access. Keep sign-in details secret and use two-step sign-in for administrator accounts (the service requires it).
- Students under 13 should be added by the academy, which issues their username and PIN, rather than signing up themselves.
3. Your responsibilities as an academy
You are the controller of the personal information about your teachers, students and parents (see section 7). In particular you:
- have a lawful basis to use their information on Fatiyyah Academy and tell them about it, including telling parents and students whether you record lessons;
- obtain any consent the law requires, including from parents of children;
- keep your own safeguarding policies, and carry out the checks the law requires for people who teach children, such as DBS checks in the UK;
- make sure lessons and content follow the acceptable use rules below.
4. Acceptable use
Everyone using Fatiyyah Academy must not:
- break the law, or harass, threaten, abuse or exploit anyone, especially children;
- record, copy or share lessons outside Fatiyyah Academy without the consent of the people in them;
- upload content they do not have the right to use, or content that is unlawful, hateful or sexual;
- try to get into other academies' data, test our security without written permission, overload the service or get around its limits;
- use the Quran text or fonts in a way their licences do not allow, or alter the Quran text.
We may suspend access that breaks these rules, telling the academy why unless the law or safety prevents it.
5. Quran text and fonts
The mushaf pages use text, layout data and fonts from the King Fahd Glorious Quran Printing Complex and Quranic Universal Library (QUL), under their terms. They are provided for reading and teaching within Fatiyyah Academy.
6. Plans and payment
[None of this section applies to an academy that is exempt from billing, as Fatiyyah Academy is in this version: it has no trial and no fees, and is not billed through Stripe.]
- New academies start with a 30-day free trial for up to 3 teachers and 30 students.
- After the trial, fees are charged in advance each month through our payment provider, Stripe, based on the plan you choose (for example per teacher seat, per active student, or both), as shown on the Billing page before you subscribe. Prices exclude VAT where it applies.
- If a payment fails we will tell you and retry for 7 days. If it still fails, or the trial ends without a subscription, the academy becomes read-only: everyone can still see and download records, but new lessons cannot start until billing is fixed.
- You can cancel at any time from the Billing page; the subscription ends at the end of the period already paid. Fees already paid are not refunded, except where the law requires.
7. Data protection
We process personal information about your teachers, students and parents on your behalf, as your processor, under the data processing terms below and our privacy notice. Our current sub-processors are listed separately.
Data processing terms
When we process personal data for you, we will:
- process it only on your documented instructions (these terms and your settings), unless the law requires otherwise, in which case we will tell you first unless the law forbids it;
- make sure our staff and contractors who can access it are bound by confidentiality;
- keep it secure with appropriate technical and organisational measures (described in the privacy notice);
- use sub-processors only under written contracts with the same protections, tell you at least 30 days before adding or replacing one, and let you object;
- help you respond to requests from people exercising their rights, and with security, breach notification, impact assessments and consultation with regulators;
- tell you without undue delay, and within 48 hours of becoming aware, of a personal data breach affecting your data;
- at the end of the service, let you export your data for 30 days and then delete it, unless the law requires us to keep it; and
- give you the information you need to show compliance, and allow audits by you or an auditor you appoint, with reasonable notice and at most once a year unless there has been a breach.
Personal data is hosted in the United Kingdom and the European Economic Area; transfers elsewhere are covered by the safeguards described in the privacy notice. The subject matter, duration, nature and purpose of processing, the types of personal data and the categories of people are those described in the privacy notice.
8. Your content
You keep ownership of the content you and your users put into Fatiyyah Academy, such as marks, notes, uploaded pages and recordings. You give us the rights we need to host and process it to provide the service to you. You can export it at any time.
9. Availability and support
We aim to keep Fatiyyah Academy available and to fix problems quickly, but we do not promise it will be uninterrupted or error-free. We plan maintenance outside common lesson times where we can and announce longer work in advance. Support is by email at support@fatiyyah.academy.
10. Ending the agreement
You can stop using Fatiyyah Academy and delete your academy at any time. We can end this agreement with 30 days' notice, or straight away if you seriously break these terms or do not pay. After it ends you have 30 days to export your data, then we delete it as described in the privacy notice.
11. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else the law does not allow to be limited. Otherwise, neither of us is liable for indirect or consequential loss, or for loss of profit, and our total liability in any 12 months is limited to the fees you paid in those 12 months, or £100 if greater.
12. Changes to these terms
We may update these terms. We will give at least 30 days' notice of changes that affect you materially; if you do not agree you can stop using the service before they take effect.
13. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, unless your local law gives you the right to use your own courts.
